MOTOR VEHICLE ACCIDENTS
Brooks, LeBoeuf, Bennett, Foster & Gwartney, P.A.
www.tallahasseeattorneys.com

Our Tallahassee personal injury attorneys have over 100 years of combined legal experience handling serious personal injury and wrongful death cases in Florida, Georgia, Alabama, and Mississippi.

Florida automobile accidents are governed by a no-fault law. Every Florida resident and certain non-residents that own a motor vehicle are required to purchase no-fault automobile insurance. Florida's no-fault automobile insurance contains Personal Injury Protection benefits, frequently called PIP benefits, to protect you when you have been injured in an accident.

Regardless of who was at fault for your accident, your PIP insurance will usually pay most of your medical bills. The benefits payable will depend on the amount and type of coverage that you have purchased. For example, under a basic no-fault policy in Florida, your own insurance company will pay 80% of your reasonable and necessary medical expenses, and 60% of your lost wages, up to $10,000.

In addition to medical expenses and lost wages, your PIP benefits may also pay for prescriptions or household help, if recommended by a doctor, plus travel expenses associated with your medical treatments. However, if you have purchased an insurance policy with a deductible, your insurance company will not pay for any of your medical bills, prescriptions or lost wages until you have met your deductible amount

In addition to the benefits you are entitled to receive from your own insurance company, you may also be entitled to benefits from the party at fault for your accident. Under Florida law, the at-fault party is responsible for any property damages sustained in the accident. You may also be entitled to expenses for a rental car for a reasonable period of time.

If you receive serious injuries from an accident that results in some form of permanent injury, such as scarring, or permanent physical impairment, Florida law entitles you, or your personal representative, to bring a claim against the at-fault party. This way, you can recover the full extent of your damages above and beyond the benefits provided by your No-Fault coverage. These additional damages include items such as past and future pain and suffering, lost wages, damage to your wage earning capacity, and future medical expenses. If you're married at the time of the accident, and you have permanent injuries, your spouse may be entitled to damages as a result of your injury.

In addition, if you purchased uninsured/underinsured motorist coverage on your own policy, you may be able to recover additional funds for your damages if they exceed the policy limits of the at-fault party, or if the other driver was uninsured.

Because the laws governing personal injury cases can be very complicated and confusing, it is essential that you seek the advice of an attorney if you have any questions. A lawyer can assist you in obtaining all of the benefits that you are entitled to under Florida law. If you decide to represent yourself following an accident and are offered money by an insurance company, it is vital that you carefully read and understand any documents that you are asked to sign in exchange for the money. If you sign a general release you will be prohibited from seeking additional money in the future, even if your injuries are more serious than you originally thought.

HARLEY-DAVIDSON ROLLS OUT NINE NEW MODELS FOR 2010
More Performance, Features and Value Across Six Motorcycle Platforms

MILWAUKEE (July 25, 2009) - Harley-Davidson roars into 2010 with nine new motorcycle models, the most expansive new-product introduction in the history of the Motor Company. Across six model platforms, Harley-Davidson achieves a fusion of tradition and technology in a motorcycle product line that offers more power, luxury, and style, and more value.

"This ambitious new motorcycle launch reaches to our riders with the incredible passion that Harley-Davidson has inspired for more than a

century," said Bill Davidson, Harley-Davidson Vice President of Core Customer Marketing. "We are thrilled to offer our customers nine new models and a full selection of products for 2010 that lets their enthusiasm for enjoying great motorcycles continue at full throttle."

Highlights of the 2010 Harley-Davidson® line include:
As the new king of the Harley-Davidson Touring line, the Electra Glide® Ultra Limited model delivers the performance upgrade of a Twin Cam 103™ engine, and features standard equipment items previously offered only as accessories on regular-production Harley-Davidson Touring models.

The new Road Glide® Custom model looks lean and mean, with a slammed suspension, 18-inch front wheel and a new 2-into-1 exhaust system.

The Wide Glide® returns as an all-new Dyna® model done in old-school chopper style, with black laced wheels, a chopped rear fender, black "wire" sissy bar, 2-1-2 Tommy Gun exhaust and an optional flame paint scheme. Priced starting at $14,499, the Wide Glide is also a great new value.

The new Street Glide® Trike brings stripped-down, hot-rod styling to the three-wheel category, and joins the Tri Glide™ Ultra Classic® in an all new Trike family for 2010.

Dressed in satin chrome and denim black, the new Fat Boy® Lo presents a darker and lower interpretation of the motorcycle that still defines the fat-custom segment.

The 2010 Street Glide® model gets even more hot-rod soul, with updates that include a larger front wheel, slimmed-down exhaust, and a new tail light assembly. Street Glide takes a classic Harley-Davidson Touring profile to a low, light and lean extreme.

No motorcycle on the road today matches the modern street attitude of the three exciting models in the Harley-Davidson VRSC™ family: V-Rod®,

Night Rod® Special and V-Rod Muscle®. The explosive performance of the liquid cooled Revolution® V-Twin engine keeps VRSC at the top of the power cruiser food chain in 2010.

The American motorcycle legend that is Harley-Davidson Sportster® features six models for 2010, including the $7,999 Iron 883™ introduced mid-year 2009 and four others priced less than $10,000.
Harley-Davidson Custom Vehicle Operations™ (CVO™), masters of shimmering chrome and bold paint, offers four new limited-production models for 2010. The CVO Softail® Convertible is a versatile urban touring motorcycle, while the CVO Street Glide is a high-performance hot-rod bagger. The CVO Ultra Classic® Electra Glide® and CVO Fat Bob® models are refreshed for 2010 with new paint schemes and styling details. All CVO models are powered by a Twin Cam 110™ engine, the largest displacement V-Twin offered by Harley-Davidson.

2012 Harley-Davidson FLD Dyna Switchback Review

With Detachable Hard Bags and Windshield, Switchback is Two Bikes in One

Easily convertible from cruising to touring, it's like two bikes in one, with no compromises.

The Dyna® Switchback™ is custom touring motorcycle with detachable hard saddlebags and quick-detach windshield. Remove those components in just seconds to turn the Switchback into a custom street cruiser. Chassis, suspension and tires are engineered to deliver light, confident handling.

The Switchback is the lightest custom touring motorcycle in its displacement category. Its styling evokes a classic proportion and clean, straightforward lines. The bend of the mini-ape handlebar and its pull-back riser combine with full-length rider footboards and a two-up touring seat to offer most Switchback riders all-day comfort.

The new Dyna® Switchback motorcycle from Harley-Davidson® is a quick-change artist. With its color-matched hard saddlebags and a fork-mounted windshield in place, the Switchback is a custom touring motorcycle. But in seconds, the detachable saddlebags and quick-detach windshield can be removed without tools. Now the Switchback is a custom street cruiser with a gleaming headlamp nacelle, five-spoke cast-aluminum wheels and a mini-ape handlebar. When it's time to head out for a long weekend, simply re-install the saddlebags and windshield, and the Switchback is ready to roll for the state line.

The Switchback is powered by a muscular Twin Cam 103™ V-Twin engine that delivers strong performance on the boulevard and on the highway. The Switchback is the lightest custom touring motorcycle in its displacement category, and at 718 pounds ready-to-ride is 94 pounds lighter than a Harley-Davidson Road King®. New front-end geometry, premium suspension components, and a low-profile front tire give the Switchback a plush ride and responsive handling.

"The new front end geometry, wheel and tire specs, and cartridge fork are engineered to work together to produce steering that's light to input and immediately responsive," Brian Scherbarth, Switchback project lead engineer. "A demo ride will reveal that Switchback is a capable touring motorcycle that's also really fun to ride."

Designed to look great with or without its saddlebags, the Switchback is styled to evoke a classic proportion and clean, straightforward lines from its 4.7-gallon fuel tank to the sweep of its full-coverage rear fenders. The bend of the mini-ape handlebar and its pull-back riser, full-length rider footboards and a two-up touring seat offer most riders all-day comfort.

CLEAN STYLING, CONVERTIBLE FEATURES

A union of opposites that sacrifices nothing, the Switchback's modern styling brings vintage Harley-Davidson simplicity to today’s roads in a look that defines classic: both true to its roots and completely contemporary. And with its detachable windshield and saddlebags, it's like having two bikes in one: a powerful, head-turning street cruiser that can also go the distance as a comfortable, easy-handling tourer.

CAST ALUMINUM WHEELS WITH FULL WRAP FENDERS

These full fenders do more than keep the mud off during your long-hauls—they add to the Switchback's unique, classic-contemporary profile. And neither are the 5-spoke hot-rod wheels just for show: they may be eye-catching, but their cast aluminum construction and balanced engineering enhance the bike's confident handling.

HERITAGE DETAILING

The Switchback’s classic retro features have a contemporary look that’ll never be lost in the crowd. From its hallmark headlight nacelle and its mini “ape hanger” handlebars, to its chromed-out fork covers and tank console with 5-inch speedo. this bike makes a modern visual statement that’s truly rooted in Harley-Davidson heritage.

PREMIUM PAINT

Up to two times thicker than the competition, custom quality paint comes standard on all Harley-Davidson® motorcycles. Clearcoat layering up to five mils deep. Bigger metal flakes. Unique effects. Skimping simply is not in our vocabulary.

HAND FINISHED FUEL TANK

All Harley-Davidson® fuel tanks are finished by hand—that's what makes them stand out. Their seamless design and unmatched style are unique among all motorcycles on the road. The tanks are one of the first and last things people notice when they lay their eyes on a Harley-Davidson® motorcycle—so we make sure it's a sight they'll remember.

TWIN CAM 103™ ENGINE POWER

Live your ride to the power of 103. The air cooled Twin Cam 103 Harley Davidson® engine delivers more stump pulling torque, while its Electronic Sequential Port Fuel Injection jetting gives crisp, lively throttle reaction. It’s a performance punch that you’ll appreciate when passing, climbing hills, or rolling with luggage packed or a passenger in back—all under that signature Motor Company rumble. And it comes at lower cruising rpm, so you ride more smoothly, with less engine vibration and better highway fuel efficiency.

TWIN CAM 103™ ENGINE HERITAGE

The knowledge of what makes an engine truly move a rider runs deep at The Motor Company, and it was put to good use when we created the Twin Cam 103 engine. We sweated bullets perfecting every cubic inch, pushing design and technology forward. And we did it all without compromising one bit of Harley-Davidson's unique styling. Evolved, yet carrying on the legacy of the Flathead, Knucklehead, Panhead, Shovelhead®, Evolution®, Twin Cam 88® and Twin Cam 96™ engines that came before. The performance and durability are a direct result of the untold miles logged on the V-Twin since 1909, and the proud heritage that comes from a century's worth of commitment to life on two wheels.

TWIN CAM 103™ ENGINE INNOVATION

Fire up the Twin Cam 103 engine and feel the low-end torque unleashed. Thanks to the lightweight piston design, delivery of the added power is more refined than ever. Then put your foot on the shifter and feel how the engine and Six-Speed Cruise Drive® transmission were designed to work together. Six speeds. A strong driveline and strong internal parts. Low routine maintenance. And a low cruising rpm couldn't feel better.

PURE HARLEY-DAVIDSON STYLING

Feast your eyes on the Twin Cam 103™ engine and there's no mistaking its roots. This is authentic Harley-Davidson style through and through with an attention to detail you won't find from any other motorcycle company. Black powder-coated heads and cylinders are highlighted by machined cooling fin tips and polished rocker covers. It's a jewel machined out of metal. Pure. Dripping with power. From the classic edge of the cooling fins to the clean lines of cases and covers—the Twin Cam 103 engine makes an ironclad statement about holding on to what's right and staying true to what satisfies.

SIX SPEED CRUISE DRIVE® TRANSMISSION

You want a ride that rumbles—not begs for mercy—when you lean on it a little. The Six-Speed Cruise Drive provides smooth, quiet shifting and reduces engine speed on the highway, so you get a better match between engine turnover and road speed. And the Isolated Drive System makes acceleration flow in a smooth, steady stream from your wrist right down to the pavement. It's a rare ride when a bike responds like this, and a low growl goes a long way when you're opening up the road ahead.

ARTFULLY HIDDEN TECHNOLOGY

Harley-Davidson leverages the latest in technology without compromising style and function. We keep the electronics hidden by skillfully routing much of the wiring harness inside the bike's frame, keeping it out of sight behind its true jewels—the tank, engine and all the other eye-popping features you want seen. It's just another way The Motor Company goes the extra mile to give its bikes that premium, top-of-the-line fit and finish.

INTUITIVE CONTROLS

Along with self-canceling turn signals that, based on the bike's speed and angle, know how long to stay on, the Switchback offers a new Flash-to-Pass switch and an the odometer trip-reset, all right at your fingertips. All these controls are incredibly intuitive, so engaging them becomes second nature quickly, letting you focus less on turning switches and more on the freedom of your ride.

ANTI-LOCK BRAKES (OPTIONAL)

Our anti-lock brakes give “stopping power” a double meaning. We keep our ABS components tastefully hidden within the wheel hub, so you'll turn heads with clean, streamlined design. But more importantly, you get certainty in the saddle knowing your bike's going to behave when you need it.

H-D™ SMART SECURITY SYSTEM (OPTIONAL)

The factory installed next-generation security system features a hands-free fob that automatically arms and disarms the vehicle electronic security functions as you approach and walk away from the bike. Stick the fob on your ignition key ring and let it do all the work. It's this attention to detail and security that make Harley-Davidson motorcycles unique.

LIGHT WEIGHT CHASSIS

You’re moving with monster power, but the Switchback is no monster to control. The chassis is tuned for a light-weight feel and easy handling, so you can move and maneuver with complete confidence, in all driving conditions—even getting it on or off its stand is easy.

CARTRIDGE-STYLE FRONT FORKS

Authentic throwback styling's easy on the eyes, but you want to be sure you're riding with state-of-the-art comfort and confidence. And the Switchback's beefy cartridge-style front forks give you top-notch smoothness whether you're blazing the blacktop across town, long-hauling to the next state, or just prowling a parking lot.

ADJUSTABLE CIGAR TUBE REAR SHOCKS

The classic-style suspension covers may add to the Switchback's vintage Harley-Davidson style, but the modern technology they’re wrapped around delivers a ride that feels anything but old school. Oil immersion damping control gives a smooth, quality ride that makes it easy to go the distance. And preload can be adjusted with just a spanner wrench, so you can easily switch your suspension to suit your riding style, touring or cruising

TUNED TO BE RIDDEN

Harley-Davidson® motorcycles are different from any other bike out on the road. There's a balance to them. The steering, the maneuverability—it's all in concert. And each Harley-Davidson model is tuned differently to create a unique riding experience for each individual no matter which bike they swing their leg over. Let's face it, we didn't get to where we are by being like everyone else.

CLEAN DETACHABLE SADDLEBAGS

When you’re touring, you want cargo space. When you’re cruising, you want style, pure and simple. With its detachable saddlebags, your Switchback is always ready for what you want. The bags’ unique design makes easy to load in your stuff, while their sealed, locking, hard-case exterior keeps it well-protected. And when it’s time to convert, they come off quickly, cleanly, no tools needed. And like the classic Harley-Davidson® motorcycles it recalls, the Switchback looks great wearing its bags or not. So go ahead, change your mood whenever you want—your Switchback can keep up.

DETACHABLE WINDSHIELD

Go from touring to cruising in a heartbeat. Attach the windshield for protection from the elements. Or detach it in seconds for a new look and ride. The Lexan® screen is as tough as they come—durable, scratch resistant, low maintenance. And whether you choose to cruise or keep the shield on, your Switchback rules with a style and versatility you can make your own.

2-INTO-1 EXHAUST

Recalling the bold pipe style of classic Harley-Davidson® motorcycles, the new 2-into-1 exhaust helps direct heat away from you and your passenger while delivering powerful performance—not to mention that signature Harley-Davidson rumble every time you crack the throttle.

FULL-LENGTH RIDER FOOTBOARDS

Your boots were made for riding, in any way you see fit. Our full-length footboards boast a tried-and-true design that's stood the test of time. Plenty of foot positions for your taste and comfort. Rubber vibration isolation for a comfortable ride.
TWO-UP SEAT

Nostalgic style meets contemporary sleekness and comfort in this deeply contoured, narrow-necked bucket. This saddle relieves pressure on your thighs, while providing back support and comfort, along with plenty of room for your friend to ride along. Additionally, premium stitching accentuates the advanced ergonomics with that sharp detail you only find on a Harley-Davidson® motorcycle. It's science in service of comfort, for the short cruise and the long haul.

SEAT ENGINEERING AND DESIGN

The seat is home for Harley-Davidson® motorcycle riders. They want a seat that has unique style without sacrificing comfort. Because of that, Harley-Davidson invests a lot of time in researching, designing and testing seats so that every bike has just the right saddle.

ENGINE IDLE TEMPERATURE MANAGEMENT STRATEGY

Our motorcycles are built to be ridden. A lot. So that means that rider comfort is top of mind. Always. With the Engine Idle Temperature Management Strategy (EITMS) feature, the motorcycle automatically cuts fuel and fire from rear cylinder when idling, which helps reduce engine heat felt by rider and passenger. This feature can easily be turned on by your dealer.

2012 Harley-Davidson FLD Dyna Switchback - Press Release 1

MORE HARLEY-DAVIDSON MODELS WITH TWIN CAM 103™ POWER IN 2012

V-Rod® 10th Anniversary Edition and Dyna® Switchback Bagger Join the Model Line

MILWAUKEE (July 20, 2011) – Harley-Davidson offers more Big Twin performance for 2012 as its Twin Cam 103™ powertrain is standard equipment on Softail® and Touring motorcycle models and most Dyna® motorcycle models. Harley-Davidson will offer two new models for 2012. The V-Rod® 10th Anniversary Edition celebrates a decade of power-cruiser performance, while the new Dyna® Switchback is a convertible custom-touring motorcycle with detachable hard saddlebags and windshield. In addition, the Night Rod Special has significant updates for 2012 with refreshed bodywork and optimized rider ergonomics. Harley-Davidson Custom Vehicle Operations (CVO)TM rolls out the gleaming new CVO Road Glide® Custom, a limited-production, high-performance touring masterpiece.

Harley-Davidson believes every motorcycle it sells can be a custom of one. Harley-Davidson H-D1™ is a comprehensive offering of customization tools for the Harley-Davidson motorcycle owner. H-D1 tools include Harley-Davidson Genuine Motor Accessories listings in print and on-line catalogs, Fit Shop and consultation services at Harley-Davidson dealerships, and factory customization and Bike Builder tools on www.harley-davidson.com. H-D1 offers almost unlimited opportunities to optimize fit, function, style and performance and turn a Harley into a motorcycle that is truly personalized to its owner.

Harley- Davidson heads into 2012 with 32 models, each born of experience that spans generations and a passion for riding that will never diminish.

Highlights of the 2012 Harley-Davidson line include:

The Twin Cam 103™ engine powers all 2012 Dyna®, Softail® and Touring models with the exception of the Dyna Street Bob® and Dyna Super Glide® Custom. This engine produces up to 100 ft lbs. peak torque, an increase of approximately 6 percent over the Twin Cam 96 engine it replaces as standard power for many of these models. The Twin Cam 103 is equipped with automatic compression release. It features identifying badges on the derby cover, timer cover and air cleaner trim ring.

A Security Package that pairs Anti-lock Braking System (ABS) with Smart Security System with proximity-based, hands-free security fob is available for all 2012 V-Rod®, Dyna®, Softail®, Touring and CVO™ models. The Security Package is standard equipment on CVO™ models and on the Road Glide® Ultra, the Electra Glide® Ultra Limited, and the Road King® Classic. The Security Package is a factory-installed option for all other models.

The Night Rod® Special is updated with new tapered tail section, lighter-weight wheels, an inverted front fork and improved ergonomics. Harley-Davidson celebrates a decade of power cruising with the V-Rod® 10th Anniversary Edition motorcycle, finished in Brilliant Silver Pearl bodywork that evokes the anodized aluminum bodywork of the original V-Rod model that introduced the liquid-cooled Revolution V-Twin engine in 2002. All V-Rod models will carry V-Rod 10th Anniversary badges.

The new Dyna Switchback combines hard saddlebags and a windshield with the eager handling and Twin Cam 103 performance of the Dyna chassis. It's a custom-touring bike ready for a long weekend trip, until the detachable bags and windshield are removed. Then in seconds the Switchback becomes a custom street cruiser with a gleaming headlamp nacelle, five-spoke cast-aluminum wheels and a mini-ape handlebar. This convertible concept makes the versatile Switchback two motorcycles in one.

All Harley-Davidson Softail models get the performance boost of the Twin Cam 103 engine for 2012. The Fat Boy and Fat Boy Lo have a new reduced-reach handlebar for more-comfortable ergonomics. A lower, narrower seat shape places the Fat Boy rider in a new "in the bike" position. The Softail Deluxe and Heritage Softail Classic will be available with a new optional "tubeless" Chrome Aluminum Profile Laced wheel option for ease of tire replacement and repair.

The Twin Cam 103 powertrain gives all Harley-Davidson Touring models assertive power for passing. On Touring models, the Twin Cam 103 is equipped with an oil cooler. All Touring models except the Ultra Limited will offer a new "tubeless" Chrome Aluminum Profile Laced wheel option.

The Harley-Davidson Sportster® line appeals to a broad range of riders with six 2012 models ranging from the race-inspired XR1200X™ to the accessible SuperLow® to Dark Custom roadsters like the Iron 883™, Nightster® and Forty-Eight®. The Sportster® 1200 Custom can be personalized for fit, function and style with H-D1 factory customization, a process that allows customers to use the Bike Builder tool on harley-davidson.com to build the motorcycle from a selection of options that are installed as the bike is assembled by Harley-Davidson Motor Company or are installed by a dealer after the motorcycle is delivered. New 1200 Custom color options have been added to Bike Builder for 2012.

The new CVO Road Glide Custom is one of four limited-production 2012 models from Harley-Davidson Custom Vehicle Operations (CVO)TM, each turned out with bold paint, gleaming chrome, and the most-powerful V-Twin engines offered in production Harley-Davidson motorcycles. CVO Road Glide Custom is a hot-rod bagger with a frame-mounted fairing topped with a smoked Wind Splitter windshield, a high-output, amplified Harman/Kardon® Advanced Audio system, and a color-matched, low-profile fuel tank console.

2012 Harley-Davidson FLD Dyna Switchback - Press Release 2

NEW DYNA® SWITCHBACK IS A CUSTOM TOURING CONVERTIBLE

With Detachable Hard Bags and Windshield, Switchback is Two Bikes in One

MILWAUKEE (July 20, 2011) – The new Dyna® Switchback motorcycle from Harley-Davidson® is a quick-change artist.

The 2009 Harley-Davidson Touring lineup is new from the ground up. The Dunlop D407 Multi-tread tires are a perfect match for the new black 28 spoke cast aluminum wheels. The new frame and swingarm provide a solid base for the new components and provide greater carrying capacity.

- New engine isolation system
- New Isolated Drive System
- New 28-spoke cast aluminum wheels, 17" front and 16" rear

Riding Impressions

I don't ride much during rainy season, so I had some concerns about the weather before starting our ride. All such concerns soon faded away—I found the 2009 Harley-Davidson FLTR Road Glide to be stable and confidence inspiring even when riding in heavy rain and windy conditions.

The wide fixed fairing provides excellent protection from the elements. My gloves and leather jacket stayed relatively dry considering the heavy rain we encountered on San Marco Pass. I noticed very minor buffeting at high freeway speeds, not surprising given the greater distance to the tall windscreen (located farther from the rider than the fork-mounted fairings on the other models). The one-piece, two-up Road Glide Classic seat allowed me to adjust my seating position during the ride, ensuring all-day comfort.

It's hard to believe the the Road Glide weighs 820 pounds while at speed. The handlebars and grip position, combined with well-placed and easy to use controls create a natural and comfortable riding position. Steering effort is light, consistent and precise, no doubt enhanced by the Road Glide’s frame-mounted fairing.

The tires have excellent grip and at times it felt more like riding a sport-tourer. 4-piston Brembo calipers, 300mm rotors (dual front and single rear) are well matched to the Road Glide's bulk. The front and rear brakes are easy to control. I was completely at ease with the balanced handling and strong brakes.

Ground clearance on the winding back roads was never an issue even when riding at a spirited "touring" pace. This sport-bike rider enjoyed riding the 2009 Road Glide even when pushing the limits.

No doubt about it, the 2009 Harley-Davidson FLTR Road Glide is up to the challenge of all-weather long-distance touring.

MSRP: Black $18,599, Color $19,049. Options included on test bike: ABS ($795) and California Emissions ($200).
